Intellectual Property Policy

1. Ownership of Content

You retain full ownership and all intellectual property rights to any content, files, documents, photos, videos, and other materials you upload to Felicloud. By using our services, you do not transfer any ownership rights to us. We claim no intellectual property rights over the content you create, store, or share through our platform. Your content is yours, and it remains yours.

2. Felicloud Intellectual Property

The Felicloud platform, including its software, website design, branding, logos, and documentation, is protected by intellectual property laws. The following elements are owned by or licensed to Felicloud:

• The Felicloud name, logo, and branding materials
• Website design, layout, and user interface elements
• Marketing materials, documentation, and support content
• Custom software code and proprietary features we develop
• Service infrastructure and architecture (excluding the Nextcloud open-source components)
• All trademarks, service marks, and trade names associated with Felicloud

3. Open Source Components

Felicloud is built on Nextcloud, an open-source platform licensed under the GNU Affero General Public License (AGPL). We respect and comply with all open-source licenses. Specifically:

• The Nextcloud software remains open source and is licensed under AGPL v3
• Any modifications we make to Nextcloud core code are made available in compliance with AGPL
• We contribute back to the Nextcloud community where appropriate
• Users have the same rights to Nextcloud software as granted by the AGPL license
• Our proprietary additions and custom integrations are separate from the open-source core

4. License to Use Our Services

Subject to your compliance with these Terms of Service, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use Felicloud services for your personal or business purposes. This license does not include the right to resell our services, copy our software or branding, or use our platform to provide similar services to third parties without our written permission.

5. Copyright Infringement and DMCA

Felicloud respects the intellectual property rights of others and expects our users to do the same. We do not monitor the content of user files due to our privacy commitments. However, if you believe that content accessible through Felicloud infringes your copyright, you may submit a notice in accordance with the Digital Millennium Copyright Act (DMCA) or equivalent European copyright laws. Upon receiving a valid notice, we will investigate and take appropriate action, which may include removing the allegedly infringing content and/or suspending the account of the user who uploaded it.

7. Counter-Notification

If you believe that content you uploaded was removed or disabled due to a mistake or misidentification, you may submit a counter-notification to our legal team. Upon receiving a valid counter-notification, we will forward it to the party who submitted the original complaint and may restore the content unless the complainant files a legal action seeking a court order.

8. Trademark Policy

The Felicloud name and logo are trademarks of Felicloud. You may not use our trademarks without our prior written consent. This includes using our name or logo in a way that could cause confusion about the source of products or services, or in a manner that disparages or discredits Felicloud.

9. User-Generated Content and Sharing

When you share files or folders with other users through Felicloud's sharing features, you grant those users permission to access and use the shared content according to the permissions you set (view-only, download, edit, etc.). You are responsible for ensuring you have the right to share any content and that sharing does not violate any third-party intellectual property rights.
