Felicloud respects the intellectual property rights of others and expects our users to do the same. This policy outlines our procedures for addressing claims of intellectual property infringement and protecting the intellectual property rights of third parties.

COPYRIGHT AND INTELLECTUAL PROPERTY INFRINGEMENT NOTIFICATIONS
Notice of Copyright or Intellectual Property Infringement
We respect the intellectual property rights of others. If you believe that a user of the Felicloud Site or Services has infringed your intellectual property rights, please notify us in writing by email to our designated agent listed below.
Important: This policy is governed by Portuguese and European Union intellectual property law. All procedures and timelines follow EU legal requirements.
Required Information for Notification
To be effective, your notification must include the following information:
Identification of the infringed work: Clear identification of the copyrighted work or other intellectual property claimed to have been infringed. If multiple works are covered by a single notification, provide a representative list of such works.
Identification of infringing material: Identification of the claimed infringing material and information reasonably sufficient to permit Felicloud to locate the material on our Site or Services, including specific URLs or file paths if available.
Your contact information: Information reasonably sufficient to permit us to contact you, such as:
Full name and address
Telephone number
Email address
Good faith statement: A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
Accuracy statement: A statement by you that the above information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf.
Signature: Your physical or electronic signature.

Initial review: Within 72 hours of receipt
Action taken: Within 7 days of verification
User notification: 24 hours before content removal
Our Response to Valid Notifications
Upon receipt of a valid notification, Felicloud will:
Immediate review: Assess the claim within 72 hours
Content evaluation: Verify the reported material within 7 days
User notification: Notify the accused user 24 hours before taking action
Content removal: Remove or disable access to the infringing material
Account action: Take appropriate measures against the user’s account
Important: We reserve the right to remove content immediately if it poses legal risks or violates our Terms of Service.
COUNTER-NOTIFICATION BY ACCUSED USER
Disputing a Copyright Claim
If we have removed your materials due to suspicion of copyright or other intellectual property infringement, you may dispute the alleged infringement by sending a written counter-notification to our designated agent.
Required Information for Counter-Notification
Your counter-notification must include:
Your signature: Physical or electronic signature
Identification of removed material: Clear identification of the material that has been removed or disabled, including the location where the material appeared before removal
Good faith belief: A statement that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
Personal information: Your name, address, and telephone number
Jurisdiction consent: A statement that you consent to the jurisdiction of Portuguese courts for any legal proceedings related to this matter
Process acceptance: A statement that you will accept service of process from the person who provided the original infringement notification

Processing Timeline:
Review period: 72 hours from receipt
Evaluation: 7 days for full assessment
Response: Decision communicated within 10 days
Restoration: Content restored within 48 hours if counter-notification is valid
REPEAT INFRINGER POLICY
Our Zero-Tolerance Approach
Felicloud maintains a strict policy regarding intellectual property infringement:
Definition of Repeat Infringer: Any user who has been the subject of one (1) valid takedown request that has not been successfully rebutted.
Consequences for Infringement
First Valid Infringement:
Immediate content removal
Account suspension pending investigation
Formal warning issued
Account termination if violation is severe
Policy Enforcement:
No warnings system – we act decisively on valid claims
Permanent account suspension for confirmed infringement
No reinstatement of terminated accounts
Forfeiture of all account data upon termination
Appeal Process
Users may appeal account suspension only if:
They provide valid counter-notification within 48 hours
They can demonstrate material was removed due to error or misidentification
They have not previously violated our intellectual property policy

Felicloud platform (based on modified Nextcloud)
Custom modifications and enhancements
APIs and technical documentation
Mobile applications and desktop clients
Branding Elements:
Felicloud name and logo
Taglines and marketing slogans
Brand colors and visual identity
Domain names and social media accounts
Unauthorized Use Prohibited
The following activities are strictly prohibited:
Copying or reproducing Felicloud content without permission
Using Felicloud branding or logos for commercial purposes
Reverse engineering our software or applications
Creating derivative works based on our platform
Reselling or redistributing our services without authorization

Legal action by BTJT LDA for abuse of our systems
Good Faith Requirement
All intellectual property notifications must be submitted in good faith. We investigate patterns of abuse and take action against users who:
Submit knowingly false claims
Use our system to harass other users
Attempt to remove legitimate content
Misrepresent their authority to act
